GENERAL TERMS AND CONDITIONS (GTC) WEBSHOP MARCEL GROSS PHOTOGRAPHY

§1 scope
These terms and conditions apply exclusively. Conditions of the customer that deviate from these terms and conditions will not be recognized unless marcelrgoss.ch has expressly agreed to them in writing in individual cases.

§2 Conclusion of the contract
(1) The presentation of the marcelgross.ch range on the Internet does not constitute an offer to conclude a purchase contract with the customer. It is non-binding.
(2) An order placed by the customer via the Internet, email, letter, telephone or other means of communication is an offer to conclude a purchase contract with marcelgross.ch. The customer receives a confirmation of receipt of the order (order confirmation). This confirmation does not constitute acceptance of the offer, but only informs the customer that the order has been received.
(3) The contract with marcelgross.ch comes about by accepting the offer by marcelgross.ch sending the ordered item (s) to the customer.
(4) marcelgross.ch can reject a customer's offer to buy without giving reasons. If marcelgross.ch cannot accept the customer's offer, the customer will be informed. Articles that cannot be delivered temporarily are noted for the customer, the customer's order remains in effect.
(5) The price stated at the time the offer is submitted is decisive for the price.

§3 delivery, shipping costs
(1) marcelgross.ch will deliver the ordered goods as quickly as possible to the address specified by the customer in the order. marcelgross.ch is entitled to carry out the order in partial deliveries. In this case, marcelgross.ch will assume the additional postage costs.
(2) In addition to the purchase price of the items, marcelgross.ch will invoice the shipping costs by post or transport company and possibly a packaging fee.
(3) Unless otherwise agreed, marcelgross.ch delivers the articles exclusively to addresses in Switzerland. The delivery time is usually 2-7 working days. Information about the expected delivery time is non-binding.

§4 retention of title, withdrawal from the contract
(1) The ordered and dispatched goods remain the property of marcelgross.ch until all payments from the sales contract have been received.
(2) In the event of illegal behavior, in particular if the customer does not meet his payment obligation despite a reminder from marcelgross.ch, marcelgross.ch can withdraw from the contract and demand the surrender of the goods still in the hands of the customer. The customer bears the shipping costs incurred.

§5 Due date and payment
(1) Only the payment methods specified during the ordering process are accepted.
(2) The purchase price as well as any packaging and shipping costs incurred are due upon conclusion of the contract.
(3) marcelgross.ch can demand partial or full advance payment without giving a reason. In this case the order will only be processed after receipt of payment.
(4) In the event of default in payment, marcelgross.ch is entitled to demand a flat-rate reminder fee of CHF 10.00.

§6 revocation
(1) The customer can cancel without giving a reason within 7 days of receipt by returning the products in perfect, unused condition to marcelgross.ch. The customer bears the burden of proof for the dispatch of the goods to be returned.
(3) The return for this reason is at the expense and risk of the customer, unless the products were incorrectly delivered.

§7 VAT
(1) If marcelgross.ch is subject to value added tax, the price shown includes the applicable statutory value added tax. Otherwise the price shown is the net price excluding VAT.

§8 Warranty and Liability
(1) If the delivered products are faulty or if the delivery is wrong, marcelgross.ch will arrange for a replacement delivery if possible.

§9 data protection
(1) The data necessary for the purchase are stored in strict compliance with the applicable statutory provisions. We expressly reserve the right to pass on personal data to other companies for the purpose of credit checking and, in the event of default, to enforce payment obligations.

§10 final provisions
(1) Thun is the exclusive place of jurisdiction for all claims in connection with the business relationship.

GENERAL TERMS AND CONDITIONS WORKSHOP / COURSES Marcel Gross Photography

§ 1 contract
These terms and conditions formulate the legal relationship between you (participant) and Marcel Gross Photography (MM) for the photo workshops organized by MG.

§2 registration
Registration for a photo workshop is made in writing using the registration form, email or post and will be dealt with in the order in which it is received. By registering, MG's terms and conditions are accepted. Your registration will be confirmed by MG by e-mail or post and is only binding with the booking confirmation.

§3 prices and payment
The prices for the respective photo workshop can be found in the advertisement, which is listed on the website www.marcelgross.ch.
The fees for the photo workshops must be paid within 30 days of receipt of the invoice or by the workshop at the latest.

§4 documents for the photo workshop
Unless otherwise agreed, the documents and further information about the photo workshop will be handed over or sent to you together with the invoice approx. 1 month before the photo workshop.
Scripts or documents for photography at the photo workshop will be handed out during or shortly after the photo workshop. delivered.

§5 rebooking
There is no entitlement to rebooking. In exceptional cases, a rebooking to an equivalent workshop can take place after consultation. A fee of CHF 50.00 is charged for this.

§6 cancellation
The photo workshop participant can withdraw at any time in writing by e-mail or post before the actual photo workshop date. If the photo workshop participant can provide a replacement to take part in the photo workshop for them, there are no costs. The appointed substitute reports to MG in writing and accepts these terms and conditions in full. If the photo workshop is canceled, the following costs apply:
For half-day and one-day photo workshops:
- Up to 21 days before the 25% photo workshop of the workshop costs
- Up to 7 days before the 50% photo workshop of the workshop costs
- 7 days and less before the 100% photo workshop of the workshop cost
For photo workshops lasting several days:
- Up to 30 days before the 50% photo workshop of the workshop costs
- Up to 14 days before the 75% photo workshop of the workshop costs
- 14 days and less before the 100% photo workshop of the workshop cost

§7 Implementation of the photo workshop
Marcel Gross reserves the right to postpone the date to a previously announced replacement date up to two days before the photo workshop date in the event of bad weather or illness.
If the minimum number of participants, as described in the announcement, is not reached, MG can cancel the photo workshop. In this case, MG tries to cancel the workshop as early as possible.
Marcel Gross reserves the right to cancel the photo workshop if the photo workshop has to be canceled due to unforeseeable circumstances (force majeure, natural disasters, epidemics, unrest, official measures or strikes) or if the photo workshop organizer is ill or is ill without a replacement date - Cancel the appointment and withdraw from the contract. In this case, MG will inform you as soon as possible and the fees already paid will be fully refunded. Further claims are excluded.
Changes to the content of the photo workshop are possible in exceptional cases (e.g. in bad weather, no access to the planned photo locations, etc.). If the photography possibilities are restricted due to bad weather, the photo workshop fee will not be reimbursed.

§8 liability

Participation in the workshops is at your own risk. The organizer is not liable for damage and accidents of any kind. The workshop participant is liable for damage caused by the workshop participant to any kind of equipment and demonstration materials loaned by Marcel Gross. By participating in the workshop, the participant declares that they agree to these conditions.

§9 copyright protection

The workshop documents submitted by Marcel Gross are protected by copyright and may not be reproduced without MG's consent. No liability can be accepted for any errors in the workshop documents. Commercial use of the pictures taken during the workshop requires the consent of Marcel Gross. After attending a photo workshop with MG, the participant is prohibited from organizing, selling or offering photo workshops with the same photo workshop content (e.g. same location). This applies for a period of 5 years after attending the photo workshop. The participants expressly agree to this regulation.

§10 data protection
The personal and contact details of the photo workshop participants are stored by MG and used by MG for its own advertising purposes, but may not be passed on to third parties.
MG may take photographs of the activities during the photo workshop and the photo workshop participants during the photo workshop and use them for advertising purposes from MG with the consent of the participants shown.

§11 place of jurisdiction / applicable law
The place of jurisdiction and fulfillment is the registered office of Marcel Gross Photography.
